There are many misconceptions with estate planning (i.e., that Wills are only necessary for senior citizens, millionaires, those who are married and those with children). This is not the case as the most important part of estate planning is to ensure that the property you own passes to the heirs and beneficiaries you desire and that your wishes are properly implemented. Other important goals of estate planning include maximizing family protection and minimizing death taxes. Estate planning documents should be reviewed periodically for changed circumstances (i.e., birth, death, adoption, marriage, divorce and changes in the estate tax laws for 2010) and I am presently reviewing and updating Wills for many clients. I handle estate planning and estate administration matters in all counties in PA and NJ. My representative experience includes: •Administering the Trust of one of America’s most renowned female philanthropists •Handling a complex estate administration involving PA, NY and Canadian real estate, a timeshare interest, gas well interests and five (5) closely held business interests •Sold real estate of an estate within three months of death in the depressed real estate market •Filed a Petition in Orphans’ Court to compel a fiduciary to provide an estate accounting •Coordinated an independent audit of a decedent’s financials for estate administration purposes •Settled a tangible personal property dispute between heirs •Prepared a Will containing various unique trusts, including a trust for minor children, a special needs trust for a disabled beneficiary and a trust for the caretaking of pets •Prepared a trust to hold the proceeds of a personal injury action settlement •Drafted a disclaimer for a beneficiary’s interest in a trust •Prepare receipt and release agreements for fiduciaries to close estates / trusts •Argued the existence of a common law marriage for PA inheritance tax purposes •Prepared a NJ inheritance and estate tax return and requested the issuance of Waivers for the liquidation and transfer of assets •Reviewed IRA / 401(k) beneficiary designations for proper tax planning.
